In addition to those services, we are regularly instructed in the collect-out of book debt ledgers, recovery of single debts or claims, or bringing actions in relation to identified antecedent transactions. As a small independent provider, we can look at any size of case or claim – no claim is too small or too large.
- Litigation & applications: against directors, shareholders or third parties in order to recover illegal dividends, preferences, transactions at undervalue and overdrawn directors’ loan accounts – all of which can be undertaken on a contingency basis, or assigned outright
- Applications & warrants (including under s.313, s.365 & s.366 Insolvency Act)
- Collection or outright purchase of outstanding invoices, book debts, ledgers, assets and claims
Many smaller IP practices choose to sell or assign debts or claims to us at an early stage; and we have the flexibility to structure such assignments in the most suitable way. We have an active in-house legal team; as well as direct access to some of the finest specialist insolvency litigators. From a simple £10,000 overdrawn DLA, to a complex multi-faceted misfeasance claim worth over £1,000,000; we have the strength, ability and acumen to act robustly and decisively.
In addition to the wide range of standard services we offer, Global has also invested in and created the UK’s only dedicated enforcement unit for Insolvency Practitioners.
The Specialist Enforcement Unit was created following our involvement in several provisional liquidations, interim receiverships and contentious liquidations. It was identified that insolvency practitioners often need an investigative and enforcement service that completely understands their unique requirements; with flexible or contingent billing arrangements. Traditional enforcement firms can’t and don’t offer this; and so we created it.
We can deploy experienced and sizeable resources to a wide variety of insolvency situations; ranging from Provisional Liquidations and LPA or Interim Receiver appointments, where assets and records need to be seized and secured quickly; to the execution of search & seizure orders obtained under the relevant provisions of The Insolvency Act. For more information on this specialist unit, please see the dedicated SEU page on our website, review the “Case Studies” section of our website, or call us on 0845 094 2572
